Tackling radicalization



Being deeply saddened by the terrible and tragic mass shooting in Orlando, Florida recently, I feel compelled to discuss a very sensitive subject. I also understand that I will be categorized as liberal or secular, but I don’t care as long as this article provokes readers to open their minds and engage in thoughtful discussion.
The terrible man who committed these depraved acts is being labeled a terrorist. Unfortunately, he was also a Muslim, which naturally caused the media to link Islam with terrorism. The phrase “radical Islamic terrorism” has been casually and incorrectly used in the media to paint all Muslims as terrorists.
How can we address this misguided interpretation of Islam as a religion that seemingly tolerates terrorists and acts of terror? Further, what does this mean for Saudi Arabia? Certainly, it is indisputable that terrorism is a real concern to Saudi Arabia as well as any other country.
Saudi Arabia is the birthplace of Islam, where Islamic law is followed. However, as in many other places, it is very normal to find a handful of people with extremist tendencies who ignore the tolerant and flexible nature of Islam and impose a kind of strict interpretation that betrays our religion and the Prophet’s (peace be upon him) teachings. These fringe elements don’t represent the majority. This fundamental issue has been so problematic and complex that it dominated and controlled thinking and intellectual discourse of some who adopted deviant thoughts.
Islam is a faith that does not require mediation from any third person to establish a direct link or relationship with the Creator. Yet, regrettably, some of our clerics talk in the name of God and his Messenger and advance their mistaken view. They claim that those opposing them actually oppose God and his Messenger. There are radical elements in every religious group. Unfortunately, due to a variety of reasons these fringe elements have somehow gained the spotlight. In fact, such radical elements have succeeded in hijacking our religion and many youths have become their victims.
Those of us who grew up in the 1960s still remember when we could go to movies and attend festivals and other forms of entertainment in Jeddah without being harassed.
Never before has our society experienced such an arbitrarily enforced conservatism. Does this mean that Islam has changed or simply that some of our religious leaders have failed to keep up with modern societal trends?
Saudi Arabia and the rest of the Arab world must devise effective solutions that can address and eradicate this scourge. These solutions must be decisive and not transitory if Saudi citizens are to live in a safe and secure nation where they can pursue their careers and raise their families. Saudi religious schools must enter the modern age to contribute to Saudi Arabia’s economic and political development.
Many reforms depend on an informed and tolerant citizenry. Justifying intolerance and ignorance breed terrorism.
The key is education. Education is the most effective means of reducing unemployment and improving an individual’s overall quality of life. Unemployment has become an appalling nightmare that needs to be addressed immediately. Additionally, granting women a more significant role to play is essential. We should neither fear nor coddle them nor, indeed, treat them as if they were creatures from a different planet. It is high time our women joined men in improving the framework of our laws. Since the dawn of Islam, women have always played significant roles in society. We have to free them from being a hostage to habits and customs that have caused the rest of the world to think of us as if we are living in the Stone Age.
There is a prevailing belief that the present situation is what the majority of Islamic society wants. I am here to unequivocally tell you that Muslims and Islam do not condone violent terrorist acts such as the shooting in Orlando.
Refusing to acknowledge the problem helps the terrorists continue their depraved actions. There is a big difference between a country that faces and suffers from terrorism and a country that supports terrorism. Saudi Arabia is clearly a victim of terrorism and not a nation that supports it. Terrorism has become a global phenomenon affecting all communities — Islamic, Christian and Jewish. Terrorism now extends from Jakarta to Dakar and from Oslo to Cape Town in South Africa. Every religion has extremists within it who foster terrorist activities whether they are Jews, Christians or Muslims, but it is terrible times like these when we must seize the initiative and move the conversation forward. We must continue to discuss reform, democracy and promote openness in Islam until we are no longer left having to defend it against those who would choose to do unspeakable acts of terror in its name.

A Suhoor Meal for the Ages


Ramadan, Muslim’s holy month, officially begins June 6th after Saudi Arabia’s Supreme Court confirmed seeing the crescent moon. For Muslims around the world, this marks a month of fasting, an increase in prayer and charity.  It is a time when Muslims try to elevate their self-discipline.
    Ramadan is among the most special times for practicing Muslims.  As we prepare for Ramadan, we see stores selling dates (traditionally an important part of Islamic tradition during Ramadan) and other specialty foods traditional eaten during this month. It is a joyous time that we Muslims look forward to all year long.
    It was with this jovial mindset that I set out to host a Suhoor gathering on the third day of Ramadan. I was keen to gather not only family, friends but our firm's VIP businessmen and women for this special “pre-dawn” meal and it will be a night none will soon forget. This unprecedented assembly of the community's most successful individuals will make for a most memorable Suhoor experience.
 I am excited to say that after receiving RSVPs from invitations sent out several weeks ago, Alnowaiser Law Firm will welcome VIPs from around the globe, the most prominent businessmen and women in the area, government officials as well as several diplomats to the prestigious and glamorous Leylaty Ballroom. One of the most luxurious spaces in all of Jeddah. The menu will be a combination of local and international dishes, tailor made by renowned French and international chefs. We set out to create an impeccable and elegant environment for my guests, which will distinguish this gathering in their minds for years to come. Ramadan being such a special time for social gatherings with friends, family and business associates, I wanted this Suhoor experience to be one for the ages.
    During Ramadan, the predominant practice is fasting from dawn until sunset. 1.8 billion Muslims around the world will partake in this practice as a time for inner reflection and contemplation. It is a time to increase our devotion to God. We fast and sacrifice food during the daylight hours to remind us of those who are less fortunate and so that we might be encouraged to be charitable. The pre-dawn meal before the fast is called the Suhoor
    I can’t wait to share the photos and video from this extraordinary event with you and I want to wish you all a most holy Ramadan.

An open letter to President Obama

Dear President Barack Obama, I am pleased that you decided to visit my country, the Kingdom of Saudi Arabia, recently. I hold no official post and am simply a Saudi attorney in private practice in Jeddah who has the greatest respect for America, as I was fortunate to be educated in your country.
Contrary to western perceptions, we here in Saudi Arabia do have freedom of speech, and that’s why I’m free to write you this letter.
In 2009 you delivered a famous speech at Cairo University where you expressed your hopes on many issues that are inspiring to all Arabs. Since then, however, many of us have seen stark contradictions in what you said and what positions your government has taken. 
Your decision to engage with Iran threatens not only our security, but America’s as well: 
l It is dangerous, bad policy to ignore 90 percent of the 1.5 billion Muslims — led by Saudi Arabia — whose interests are irreconcilable with Iran’s domestic and foreign policies. 
l We agree with you that diplomacy is better than waging wars, but this does not mean that the United States — the world’s superpower — should be transformed into a wounded lion while Iran threatens its neighbors and continues its expansive and aggressive policy to destabilize the entire Middle East. Your diplomatic efforts threaten to expand, rather than eradicate, terrorism. 
Those who support western notions of a civil society, order and social tolerance are put at high risk by a worldview, which promotes disorder and revolution and is driven by the goal of world domination. 
Mr. President, do not assume that cooperation is possible with an Iran bent on destroying its adversaries. 
You recently said in The Atlantic Monthly that regional “competition” between Saudi Arabia and Iran has fueled the conflicts in Yemen, Iraq, and Syria, and you expressed the belief that the Saudis should “share” the region with their fierce regional enemy! Would you have us share the Middle East with President Assad, a murderer of women and children, who is fully supported by Iran even as you recognize that there is no place for him on the world map?
You are relying on your intelligence capabilities, but the terrorists remain many steps ahead of the United States, especially in social media outreach to our disaffected youth. For the sake of America and your true friends in the Middle East, please don’t defer any decisive action against Iran just to pass your remaining months in office with the illusion that you have contained Iran’s ambitions. 
Even if you have defused Iran’s nuclear weapons temporarily, Iran has the financial resources to threaten not only Saudi Arabia, but also Israel, Europe and ultimately the United States. All we have to do is look at Syria to see how Iranian involvement has destroyed that sad country and destabilized other countries around it.
One must ask: 
l How can you allow the continuation of monstrous crimes against humanity occurring in Syria, Iraq, Palestine and elsewhere?
l Does America really want to be seen as doing nothing to stop aggressive Iranian expansion fueled by unlimited Russian support? 
l Don’t you realize that Saudi Arabia is the safety valve of the Middle East? It has always maintained stability and security in the region. Saudi Arabia will stand shoulder-to-shoulder with the United States, but you must lead the fight against Iran, not appease them. They are bent on dominating the Middle East, not stabilizing it; they are committed to destroying those who have different religious, cultural and political beliefs. They are the world’s greatest sponsors of terror.
Mr. President, I am an Arab Saudi citizen without any connection to the Saudi government who simply wants America to continue exercising its great influence internationally. With great power comes great responsibility. Our long-standing relationship with you is not only deep between our governments, but also among our citizens. Now, more than ever, America must remember who are its friends and who are its enemies.

يا سمو الأمير .. هذه مقترحاتي لرؤية 2030










 الخميس 28 رجب عـام  1437 الموافق لـ5 ماي 2016


خلقت رؤية 2030 التي طرحها ولي ولي العهد صاحب السمو الملكي الأمير محمد بن سلمان، بداخلنا بصيصاً كبيراً من الأمل والتفاؤل نحو مملكة جديدة تقوم بدورها الريادي في المنطقة، تفرض حضورها بمشاريعها العملاقة، واقتصادها المتنوع الذي لا يعتمد فقط على النفط وأسعاره أو أي سلعة مهما كان حجمها أو أهميتها، بل وبيئتها الصحية الجاذبة للسياحة والاستثمار.
وحتى تكتمل الصورة المبهرة التي رسمها برنامج التحول الوطني.. اسمحوا لي يا سمو الأمير أن أطرح خمس نقاط ربما تحمل إضافة لهذا العمل الطموح الذي ستلتف حوله كل العقول والأفئدة خلال السنوات القادمة.

هيئة تشريعية جديدة: حتى نكون واقعيين فإنه من الواضح أن مجلس الشورى والجهات الحكومية الأخرى ليست قادرة على مواكبة وتيرة الحياة المتسارعة التي تتطلب إصدار التشريعات والأنظمة باستمرار لتتماشى مع الحركة الاقتصادية التي تسابق الزمن في سرعتها وحركتها.. فمن يطلع على النظام الأساسي للحكم (المادة 67) وكذلك نظام مجلس الوزراء (المادة 20) ونظام مجلس الشورى (المادة 15) يلاحظ أن هناك تشابكا واضحا في اختصاص السلطات.


وما دامت التشريعات أحد أركان النهضة الحضارية والتنموية، بات من الضروري وجود سلطة تشريعية منفصلة قادرة على مجابهة كل التحديات، تستوعب طموحاتنا وتساهم في تحويل أحلامنا إلى واقع، لا نقلل من عمل مجلس الشورى الذي يضطلع بمهمات جسام واستحقاقات عديدة وكذا الجهات الأخرى، لكن وجود هيئة تشريعية متفرغة ومنفصلة عن السلطات الأخرى بات أمراً ملحاً.


تعزيز مكانة المرأة: يعد حصر دور المرأة السعودية في أعمال بعينها تعطيلاً لنصف طاقة المجتمع وحرمانه من فرص عديدة في التنمية، وهو ما أكده سموكم أكثر من مرة، ولا يمكن أن ننشد أي تطور حقيقي على أرض الواقع في ظل القبضة التي يمارسها بعض المتزمتين على المرأة السعودية التي وصلت إلى مراكز علمية وفكرية غير مسبوقة، ومن المهم مجابهة القيود التي فرضها بعضهم على المرأة، ولا علاقة لها من قريب أو بعيد بالدين الإسلامي الحنيف الذي كرم المرأة ووضعها في مكانة كبيرة، لكنهم استندوا على عادات وتقاليد تحتاج إلى إعادة نظر، فهؤلاء من عارض تعليم المرأة ورفضوا عملها.. وعادوا بنفس أسطوانتهم في زمن لم يعد يحتمل تزمتهم، فهل يجوز ونحن في عام 2016 أننا ما زلنا نناقش ـ على سبيل المثال - قضية قيادة المرأة للسيارة التي صرفتنا عن أمهات القضايا؟


فالمرأة ـ يا سمو الأمير ـ بحاجة إلى دعمكم وقراراتكم الشجاعة، ولا ينبغي أن تترك تحت تأثير وجهات نظر مجتمعية، فكم هي القرارات الكبيرة والمهمة التي وجدت اعتراضاً من بعض شرائح المجتمع ثم عادوا هم أنفسهم وقبلوها؟


المشاركة في صناعة القرار: يصعب على أي حكومة على وجه الأرض أن تحمل بمفردها أعباء التحديات الداخلية والخارجية دون مشاركة شعبها.. فما بالك بدولة مثل السعودية تمتد على مساحة قارة كاملة، وتملك شعباً محباً لقيادته.. ومتفاعلاً مع كل قراراته.


لقد قلت يا سمو الأمير في حوارك التاريخي بقناة العربية: «من لا يرضى بالسياسة الجديدة سيصطدم بالشارع»، وهي كلمات تعطي مؤشراً واضحاً بأن الرؤية السعودية ترتكز على توسيع المشاركة الشعبية، ولا شك أن تعزيز الشراكة بين الحكومة والشعب كفيل بمواجهة كل التحديات المستقبلية، وسيضطلع المواطن بدور فعال وإيجابي في نجاح خطط التحول الوطني، مع ضرورة تفعيل مؤسسات المجتمع المدني حتى تكون أحد أركان نهضة المجتمع وتقدمه.


مركزية المناطق: جاءت رؤية 2030 لتنهض بجميع مناطق السعودية.. وإذا كان الأمر كذلك ـ وهو كذلك بإذن الله ـ فإنه يفترض أن تكون هناك صلاحيات مالية وإدارية تبعد إدارات المناطق عن المركزية القائمة التي أعاقت حركة التطوير والتطور سنوات طويلة، حتى تستطيع أن ترى الرؤية النور، ولتكتمل الصورة لا بد من تفعيل دور المجالس البلدية وتوسيع صلاحياتها لتصبح مسؤولة بشكل أكبر في تقويم وتوجيه المشاريع التنموية وتقديم قيمة مضافة، ولا ينحصر دورها في التصديق والتوقيع على محاضر الأمانات!


ما زالت بعض الأنظمة الإدارية العتيقة ـ يا سمو الأمير - حجر عثرة في طريق التنمية، والكثير من المناطق تضطر أن تعود إلى الوزارات المعنية مع كل قرار تتخذه، وبات أمر توسيع الصلاحيات الممنوحة لكل منطقة مالياً وإدارياً لمواكبة مرحلة التغيرات من نافلة القول، مع الابتعاد بشكل كبير عن المركزية الموجودة.. فالوزارات في الدول المتقدمة تتولى المهمات الإستراتيجية الوطنية.. وتضطلع بوضع وتنفيذ السياسات العامة والخطط التنموية.. أما التنمية المحلية فتتولاها الإدارات المحلية.


مكافحة الفساد والبيروقراطية: لا يخفى على سموكم أن الفساد أشبه بالسرطان الذي ينخر في جسد الإنسان حتى يدمره، وقد كنتم ـ رعاكم الله ـ متيقظاً لهذا الأمر في حديثكم التاريخي لقناة العربية، وأشرتم إلى الهدر الذي حدث في سنوات سابقة، ولا شك أن الفساد والبيروقراطية سيكونان أكبر عدوين لبرنامج التحول، لذا نحتاج جهازا رقابيا يقظا، محترفا، متفرغا، مهمته الأساسية كشف كافة أنواع الفساد وإزاحة المتسببين في البيروقراطية.. فهيئة مكافحة الفساد لن تستطيع بمفردها أن تفعل المستحيل.. لأنها تركز في معالجتها على القاع فقط.. ولا بد أن تكون محاربة الفساد على جميع الأصعدة.


وقبل الختام.. لا يفوتني التأكيد على أهمية السماح للأجانب بتملك العقار دون وجود أي عوائق، خصوصا أن النظام قد صدر منذ مدة وكل ما يحتاجه التفعيل فقط، وهذا سيساعد على الانتعاش الاقتصادي، لاسيما أن سموكم بادر بطرح مبادرة «الغرين كارت» التي ستحد أيضاً من هجرة الأموال إلى الخارج.. وسيكون تملك العقار مع الغرين كارت خطين متوازنين يكمل بعضهما بعضا.


أخيراً.. نأمل أن يتحول موعد صدور الرؤية (25 أبريل) إلى مناسبة وطنية ترسم التفاؤل والأمل على وجوهنا.. وتتواكب سنوياً مع مكاشفة مباشرة لسموكم تحدد فيها ما تم إنجازه من الرؤية.. وتضع النقاط على الحروف حتى تستمر حالة التفاعل والتفاؤل.


حمى الله المملكة بقيادة ملك الحزم والعزم الملك سلمان بن عبدالعزيز، وولي عهده الأمين صمام الأمن والأمان، وسمو ولي ولي 

عهده صاحب الرؤى والمبادرات المهمة والكبيرة، فليحفظهم الله جميعاً للوطن.. ويسدد خطاهم

The Saudi Soldier Day

Words of praise are no longer sufficient to express our love and appreciation to those heroes who work around the clock to preserve our national security. They offer their souls and blood for the sake of our nation and adore it with every breath they take.

It is long past time to honor these heroes. I propose an initiative that is simple in detail but grand in meaning: an annual national holiday designated as “The Saudi Soldier Day” to celebrate our heroes. Let us dedicate 24 hours out of the 8,760 hours in an entire year to celebrate those brave men of the Ministry of Defense and The National Guard who are stationed along the borders and are the nation's strong eyes and arms, or the men of the Ministry of Interior who relentlessly protect our safety, or the various military institutions that offer innumerable sacrifices and acts of bravery to keep our great nation safe and strong.

The Saudi soldier has demonstrated loyalty, fidelity, and love to the Kingdom. He is only satisfied when he is in danger showing a brave heart and an adventurous body. He has said goodbye to all that is dearest to him and has achieved one of two glories: martyrdom or victory. His heroic actions are far too many to be recounted in books or works of art. He has consistently raised high the banner of unification and glory while defeating dark terrorism and forcing out those who tamper with our country's goals, both internally and abroad.

There is no question that these heroes have unlimited support from our leaders, headed by The Custodian of the Two Holy Mosques, King Salman bin Abdulaziz, His Highness Crown Prince Mohammad bin Naif, and His Highness Deputy Crown Prince Mohamad bin Salman. Our soldiers are well taken care of and receive recognition, yet having a day celebrating them will demonstrate Saudis’ support of all they do. It will show a simple message of true faithfulness and immense gratitude.

Certainly, our leaders give great support to all of our military personnel. As citizens, we too are incredibly proud of our soldiers who possess the expertise and psychological readiness to defend us. It is now time that we set aside one day each year to show our steadfast support and gratitude for them.  It also will send a clear message to our young people that a soldier’s service to the Kingdom is valued.

The celebration honoring our soldiers and security men on all fronts will be no ordinary day, and the hours and minutes will not pass by as they do on any usual day. All of its moments will communicate a message of love from faithful citizens who have been blessed with safety and security thanks to God and their bravery and dedication. This day will be devoted to teaching about the heroism of the martyrs and identifying the risks that the nation faces. It will encourage our youth to be courageous and fearless and to make these heroes their idols. The day will include mass celebrations in one of the major sports fields with a national operetta that will recount tales of glory and bravery.


However, this idea will remain incomplete unless we establish a fund called "The Nation Protectors' Fidelity Fund" that will provide sufficient funding to the families of martyrs, the sick and their families, the disabled, and those who are in difficult circumstances.

Some may object to the idea of the Fund and say that our country is capable of supporting our soldiers and that this Fund may send a contradictory or duplicative message.

To those I say: Our country supports our sons abundantly, but through this Fund, we will be playing a complementary role that reflects national unity and the pride that the civil society has in its heroes.

It is important that this Fund be adopted by a major civil and economic entity represented, for example, in the Council of Saudi Chambers in the form of an endowment until it takes on a sustainable form. It should have a bank account in all Saudi banks so citizens can contribute to it. A Board of Trustees should be formed including representatives from the Ministries of Defense, Interior and Social Affairs, other military institutions, religious scholars, academics, and renowned businessmen who are experienced in the field of charity. I also suggest that a workshop be organized to promote and implement “Saudi Soldier Day”.

The soldier, with his sacrifice and vigilance, has become a beacon of the country's stability and the safety of its people. He has captured a piece of our souls and therefore we extend to each of our heroes our immense gratitude and prayers.

عدم الاختصاص في الدعوى التحكيمية

الأحد 17 صفر 1434 هـ. الموافق 30 ديسمبر 2012 العدد 7020

إن الدفع بعدم اختصاص هيئة التحكيم يُعد من الدفوع الشكلية المهمة التي يجب على هيئة التحكيم الفصل فيها قبل السير في الدعوى ونظر موضوعها وفقاً لما هو مستقر عليه نظاماً بوجوب الفصل في الدفوع الإجرائية (الشكلية) قبل الفصل في الدفوع الموضوعية.

كما يُعد من الدفوع الشكلية المهمة التي يلزم الفصل فيها قبل الدخول في الموضوع أيضاً الدفع بعدم وجود اتفاق تحكيم أو سقوطه أو بطلانه أو عدم شموله لموضوع النزاع التحكيمي.

لقد تطلب نظام التحكيم الجديد الصادر بالمرسوم الملكي الكريم رقم (م/34) وتاريخ 24/05/1433هـ أن يبدي دفع عدم الاختصاص من المحتكم ضده في مذكرة دفاعه أو على استقلال في الميعاد المحدد لتقديم مذكرة الدفاع، سواء كان هذا الميعاد قد تم تحديده باتفاق الطرفين أو عينته هيئة التحكيم، وهذا ما تم النص عليه في المادة (العشرين) من نظام التحكيم الجديد بالقول ''1- تفصل هيئة التحكيم في الدفوع المتعلقة بعدم اختصاصها بما في ذلك الدفوع المبنية على عدم وجود اتفاق تحكيم، أو سقوطه، أو بطلانه، أو عدم شموله لموضوع النزاع.

2- يجب إبداء الدفوع بعدم اختصاص هيئة التحكيم وفقاً للمواعيد المشار إليها في (2) من المادة (الثلاثين) من هذا النظام''، وبذلك يكون المنظم قد منح الحق لهيئة التحكيم في الفصل في الدفع الخاص بعدم اختصاصها أو عدم وجود اتفاق تحكيم أو سقوطه أو بطلانه، وأن تفصل هيئة التحكيم بنفسها في هذا الدفع، ويُعد هذا الأمر من الأمور الجديدة المهمة التي نص عليها نظام التحكيم الجديد ولم يكن منصوصاً عليه في نظام التحكيم السابق، ويرجع السبب في ذلك إلى مقدرة هيئة التحكيم على الفصل في هذا الأمر، وأيضاً لضمان سرعة الفصل في الدعوى التحكيمية كضمانة من ضمانات التحكيم.

أما فيما يخص الميعاد الذي يجب التقيد به لإبداء الدفع بعدم الاختصاص أو عدم وجود اتفاق تحكيم وما يرتبط به من دفوع شكلية أخرى، فقد تم النص عليها في الفقرة الثانية من المادة (الثلاثين) من نظام التحكيم الجديد التي تضمنت ''يرسل المدعى عليه خلال الميعاد المتفق عليه بين الطرفين، أو الذي تعينه هيئة التحكيم إلى المدعي وإلى كل واحد من المحكمين، جواباً مكتوباً بدفاعه رداً على ما جاء في بيان الدعوى، وله أن يضمن جوابه أي طلب متصل بموضوع النزاع، أو أن يتمسك بحق ناشئ منه بقصد الدفع بالمقاصة، وله ذلك ولو في مرحلة لاحقة من الإجراءات إذا رأت هيئة التحكيم أن الظروف تسوغ التأخير''، ويترتب على عدم تقديم هذه الدفوع في المدة المتفق عليها أو التي تقررها هيئة التحكيم سقوط الحق في إبدائها بعد ذلك أو التمسك بها، ويُعد ذلك تنازلاً من الخصم في التمسك بهذا الدفع، إلا أن سقوط هذا الحق لا يُعد من النظام العام، فلا يجوز أن تقضي به هيئة التحكيم من تلقاء نفسها، إذ يجوز أن تقبل هذه الدفوع إذا كان هنالك سبب مشروع ومقبول أدى إلى تأخير الدفع به بعد الميعاد المحدد في المادة السابقة.

وبذلك يكون نظام التحكيم قد أوكل إلى هيئة التحكيم اتخاذ الإجراء الذي تراه مناسباً سواء بشأن قبول الدفع في مدته النظامية أو بعد انقضاء المدة المنصوص عليها نظاماً، كما يجوز لصاحب الدفع إذا ما أبداه أن ينزل عنه صراحة أو ضمناً أثناء سير الدعوى التحكيمية، كما لا يترتب على قيام أحد طرفي التحكيم بتعيين محكم أو الاشتراك في تعيينه سقوط حقه في الدفع بعدم الاختصاص أو الدفوع الأخرى المنصوص عليها في المادة العشرين، وهي عدم وجود اتفاق تحكيم أو سقوطه أو بطلانه أو عدم شموله لموضوع نزاع التحكيم.

وإذا انتهت هيئة التحكيم إلى رفض الدفع بعدم الاختصاص، سواء كان هذا القرار قبل الفصل في موضوع نزاع التحكيم أو مع الحكم الصادر منها، فإنه ليس للخصم أن يعترض على هذا القرار، إلا حال طعنه بدعوى بطلان حكم التحكيم المنهي للخصومة كلها وفقاً للمادة (الرابعة والخمسين) من هذا النظام التي نصت على أنه ''لا يترتب على رفع الدعوى البطلان وقف تنفيذ حكم التحكيم. ومع ذلك يجوز للمحكمة المختصة أن تأمر بوقف التنفيذ إذا طلب مدعي البطلان ذلك في صحيفة الدعوى، وكان مبنياً على أسباب جدية. وعلى المحكمة المختصة الفصل في طلب وقف التنفيذ خلال خمسة عشر يوماً من تاريخ تقديم الطلب. وإذا أمرت بوقف التنفيذ جاز لها أن تأمر بتقديم كفالة أو ضمان مالي، وعليها إذا أمرت بوقف التنفيذ الفصل في دعوى البطلان خلال 180 يوماً من تاريخ صدور هذا الأمر''.

Death penalty in Saudi Arabia

I realize that this is another very sensitive subject, but I would like to make two important points in order to dispel any confusion or misunderstanding.

When I discuss a matter having religious implications, I do not mean to criticize the divine Islamic religion itself, of which I can only express admiration, respect, and my sincere devotion. However, I will criticize the wrongful practice of the religion when it betrays Islam’s fundamental principle of human rights. Narrow mindedness and ignorance by some have no place in upholding the greatness and true essence of the Islamic religion

Further, when I criticize anything that is related to Saudi Arabia, I am not trying to tarnish any aspect of our great country. The Kingdom has achieved wonderful things and it has always been a source of pride for all its citizens.
However, we have reached a stage in our nation’s development when we must be more honest and transparent in addressing our problems, especially now when we live in a world entirely different from the past. There is no need (as the Arab media have tried to do in the past) to keep misleading others and ourselves as if everything is perfect and there is no room for improvement in our policies.

The issue of the death penalty as imposed in the Kingdom is a matter worthy of contemplation, considering all its civil, human and moral dimensions, especially now when we live in a time that emphasizes the importance of human rights issues like never before and when Saudi Arabia needs to promote a positive image to the world. It is well known that the Kingdom imposes the death penalty in accordance with the provisions of the Shariah. This is something that we all acknowledge, but consider the following:

1. If the death penalty is imposed on the basis of texts in the Holy Qur’an that says, for example, “If anyone slays a human being – unless it be (in punishment) for murder or for spreading corruption on earth – it shall be as though he had slain all mankind,” “for, in (the law of) just retribution, O you who are endowed with insight, there is life for you, so that you might remain conscious of God,” or on any other verses, this requires thorough examination. We must consider the text in the context when it was written and what the circumstances were at that time. For example, some Qur’anic verses are associated with a certain event that occurred in the lifetime of the Prophet Muhammad (peace be upon him), such as the saying “Indeed, when we return to the city, (we) the ones most worthy of honor, will surely drive out therefrom those most contemptible ones !” One is left to wonder how long the worthy ones have to drive out the contemptible ones: A year, a decade, or a century?

The verse is not specific, so we simply don’t know. This verse was sent down by the Lord concerning the biggest hypocrite Abdullah Bin Abi Bin Sallul and those who took part with him in one of the invasions. This text and other similar texts were associated with a certain period, context and event. How can some people insist on reciting texts without thinking about the reasons and circumstances then existing or considering their context?

2. Let us ponder that there is no place for jurisprudence in the presence of a relevant text in the Holy Qur’an. Why did Caliph Al-Farooq stop granting the people who converted to Islam, without being deeply convinced by this religion, their share from alms giving (Zakat), although it was mentioned in the Holy Qur’an, declaring that there was no need for them? Moreover, and also as an act of jurisprudence, he suspended one of the Islamic penalties of theft in the year of Cinders (Aam Al-Ramada). Didn’t these texts exist at that time as well? Didn’t Caliph Al-Rashid issue a jurisprudence in spite of the existence of the texts very clearly in the Holy Qur’an and sought to achieve the interests of the Muslims without abiding by a specific text?

3. Furthermore, since the Kingdom abides by Shariah, then Shariah includes many other penalties that are no longer imposed or probably never have been imposed as punishments (an eye for an eye, a nose for a nose, an ear for an ear and a tooth for a tooth). The Kingdom stopped — or even did not practice at all — the gouging out of eyes, the cutting off of noses and ears, the breaking of teeth, and the cutting off hands of thieves. Yet these penalties are included in clear and explicit Qur’anic texts as stated above. How can this be when religion is followed as a whole and not in parts, that is, it cannot be divided or classified?

The truth is that the Kingdom has been misunderstood and is suffering the consequences because of some so-called scholars who are experts in memorizing and reminiscing instead of contemplating and studying.
All this leads to talking about execution. Why are people in the Kingdom executed so quickly after judgment is passed when we all should acknowledge that every soul that is created by God can only be reclaimed by the Creator himself? Is this the result of the Qur’anic texts or some other reason? If the texts are the reason, it is clear that clinging to the text without taking into account the factors, circumstances and times of these verses is worrying and dangerous.

I realize that some persons will argue that Islam requires the death penalty in many instances, and I respect and obey the Islamic religion. I am keenly aware this subject may have political implications that may offend some religious groups. I call on Saudi Arabia to seek a Fatwa to limit the death penalty only to terrorism, drug dealing and similar heinous crimes and not extend it to other criminal offenses.

Further, why aren’t those who are convicted of a serious crime or murder given a period of time – let’s say, 10 years – before they are put to death?

Perhaps some new evidence or documents may come to light establishing their innocence during this period. Finally, the manner in which this penalty is executed, with a sword and in public, is not in any way compliant with the simplest human rights; a criminal or a convicted person, regardless of his crime, must have his dignity and pride, even if he is to be killed. So, why not use modern technology instead of the sword, which is such a harsh and outmoded means of execution? Why can’t he be executed – if at all – by more humane means?

We are living in an era of human rights. These rights may not be infringed, whatever the claim or excuse, for the concept of human rights is international
.
The Kingdom has defended human rights at every international convention and through every platform. Custodian of the Two Holy Mosques King Abdullah has been personally engaged in the pardoning process of more than one killer in spite of his busy schedule and endless responsibilities. This simply shows to the Saudi citizens and the world that the Kingdom is a nation of peace, harmony and humanity and that the Islamic religion is a religion of forgiveness, love and affinity. But, we must now hope that these generous initiatives by the king evolve into legislation furthering human rights. Are we strong and enlightened enough to achieve this ideal?

البيئة الاستثمارية والمأمول بعد نظام التحكيم الجديد

ما لا شك فيه أن المملكة تحرص كل الحرص على تنمية وتشجيع البيئة الاستثمارية وتعمل على إزالة الهواجس والمخاوف التي انتابت وما زالت تنتاب المستثمرين، الوطنيين منهم والأجانب، بشأن الاحتكام في منازعاتهم إلى المحاكم القضائية السعودية بسبب بطء الفصل في القضايا والتأخير في تنفيذ الأحكام ما يؤدي إلى ضياع الحقوق.
وكان أحد الخيارات هو نظام التحكيم السعودي القديم الذي - مع الأسف - لم يحقق رغبات المستثمرين وتطلعاتهم، الأمر الذي تطلب إلغاء هذا النظام وصدور نظام جديد للتحكيم بالمرسوم الملكي رقم (م/34) وتاريخ 24/5/1433هـ، وعمل هذا النظام على ترسيخ الشفافية وتبسيط إجراءات التحكيم وسلاستها لسرعة الفصل في القضايا التحكيمية، كما شمل الاعتراف بوسائل الاتصال الحديثة في الإثبات مثل الإيميل وغيره، إضافة إلى إنشاء مركز تحكيم سعودي وأحقية أطراف التحكيم في اللجوء إلى مراكز التحكيم الدولية، وفي الاحتكام إلى قواعد قانونية غير المنصوص عليها في النظام السعودي، وذلك تحقيقاً لرغبات المستثمرين السعوديين أو غيرهم على حد سواء في الاحتكام إلى نظام يختارونه بأنفسهم لضمان سرعة الفصل في القضايا وقلة التكلفة، ما يجعل المملكة بيئة استثمارية واعدة.
والحقيقة أن نظام التحكيم الجديد لا يعدو أن يكون إلا إحدى الخطوات الكبيرة التي انتهجتها المملكة بهدف تنمية البيئة الاستثمارية فقد سبق صدور هذا النظام صدور أنظمة عدة أخرى، أهمها على وجه الإطلاق نظام القضاء الجديد الصادر بالمرسوم الملكي رقم (م/78) وتاريخ 19/09/1428هـ متضمناً التأكيد على استقلالية القضاء في المملكة وتعدد درجات التقاضي في محاكمه المختلفة - الدرجة الأولى ومحكمة الاستئناف ثم المحكمة العليا - كما تضمن النظام - أيضاً - زيادة اختصاصات القضاء ومنها نظر منازعات الاستثمار، التي هي في إطار التفعيل قريباً بعد إلغاء لجنة تسوية منازعات الاستثمار، ما يعطي ثقة للمستثمرين الوطنيين والأجانب في عرض منازعاتهم على القضاء ليصب ذلك في مصلحة المستثمر للاستفادة من الإجراءات النظامية والإجرائية المستحدثة التي تؤدي إلى سرعة الفصل في القضايا وتنفيذ الأحكام، إضافة إلى التزام المملكة بالاتفاقيات والمعاهدات الدولية التي وقعت عليها والخاصة بالاستثمار مثل اتفاقية تنفيذ الأحكام الصادرة عن جامعة الدول العربية عام 1952 واتفاقية نيويورك لتنفيذ أحكام المحكمين الأجنبية لعام 1958، التي انضمت إليها المملكة عام 1994.
كما لا يخفى أنه يحق للمستثمرين السعوديين والأجانب اللجوء إلى قواعد تحكيم غرفة التجارة الدولية في باريس لحل منازعاتهم؛ لأنها تُعد ملاذاً لحل المنازعات عن طريق قواعد التحكيم الخاصة بهذه الغرفة لما تتمتع به من سمعة دولية مرموقة، وهذا لم يمنعه نظام التحكيم السعودي الجديد خدمة للمستثمرين الذين يأملون الكثير حال تفعيل وتطبيق هذا النظام وبعد أن تصدر لائحته التنفيذية.
وعلى الرغم من ذلك كله، وحتى يمكن تفعيل وتشجيع الاستثمارات داخل المملكة بشكل صحيح وفاعل فإنه يقترح ما يلي:
1- إنشاء محكمة اقتصادية مستقلة بجانب المحاكم العامة والإدارية وليست دائرة في محكمة قضائية على النحو المنصوص عليه في المادة 6 من النظام القضائي الجديد الصادر بالمرسوم الملكي رقم م/78 وتاريخ 19/9/1428هـ، تُعنى بقضايا الاستثمار والتجارة فقط وتختص بالنظر في الطعون المقامة ضد الأحكام الصادرة عن هيئات التحكيم ويكون حكمها باتاً ونهائياً وغير قابل للطعن، على غرار ما عليه بعض النظم القانونية العربية والأجنبية الأخرى.
2- استفادة اللائحة التنفيذية المزمع إصدارها لنظام التحكيم السعودي الجديد من الأحكام المستحدثة في القواعد الإجرائية للمحكمة التجارية الدولية التابعة لـICC، لا سيما أنها عُدلت أخيرا هذا العام 2012 نظراً لحداثتها ولأنها محكمة دولية مرموقة ذات باع طويل في هذا المجال.
3- أن يكون لمركز التحكيم السعودي المزمع إنشاؤه - المذكور في نظام التحكيم الجديد - قوة وصبغة قانونية في اعتماد إجراءات التحكيم، على أن تُحدد الشروط والضوابط الخاصة بإدارته وشروط اختيار المحكمين التابعين له، وتنظيم العملية التحكيمية وأيضاً تحديد مسؤولياته في حال حدوث أضرار بالغير وأن يكون نظامه متوافقاً مع أنظمة مراكز التحكيم الدولية لضمان تحقيق غايات التحكيم المنشودة ونيل ثقة المستثمرين.
4- منح الفرصة للمستثمرين المحتكمين في اختيار محكميهم من غير المحامين مثل اختيارهم مهندسين أو فنيين أو محاسبين لإلمامهم بالموضوعات الفنية محل الدعوى التحكيمية، على النحو المتعارف عليه في أنظمة التحكيم المختلفة، حيث إنه يُلاحظ أن النظام الجديد لم يعط الحق لغير حملة شهادة العلوم الشرعية أو النظامية في رئاسة هيئات التحكيم أو في حال كون المحكم فرداً، وهذا يقيد إرادة المستثمرين الذين قد يرون في بعض المجالات مثل عقود المقاولات أو غيرها أنه من الأفضل لهم أن يتم اختيار محكَم ذي خلفية فنية، وهو المعمول به في كل أو كثير من دول العالم.
5- وضع آلية عملية ومحددة لضمان تفعيل اتفاقية نيويورك لتنفيذ الأحكام الأجنبية الصادرة عام 1994 وغيرها من الاتفاقيات الدولية المعنية، لا سيما بعد أن أصبح التحكيم السعودي يغطي الطابع الدولي، وذلك لضمان سرعة الفصل في القضايا وتحقيق آمال وتطلعات المستثمرين وعدم التناقض مع المراكز الدولية الكبرى سواء الـICC أو غيرها، وهذا لعمري سيخلق بيئة خصبة في الاستثمار في المملكة.
6- البدء بعقد دورات تدريبية للمهتمين بالتحكيم محلياً ودولياً سواء كانوا قضاة أو محامين أو مهنيين أو رجال أعمال أو غيرهم، لبيان المستحدث في أحكام التحكيم خصوصا التحكيم الدولي وما أوجه الاتفاق والاختلاف بين نظام التحكيم السعودي والأنظمة الأخرى وما الدور المتوقع والمأمول لمركز التحكيم الجديد المزمع إنشاؤه حسب النظام والتعاون بين الجهات الحكومية وغير الحكومية العاملة والمهتمة بالتحكيم إلى جانب عقد فعاليات يشارك فيها المستثمرون وغيرهم من شرائح المجتمع المختلفة لنشر ثقافة التحكيم وتأكيد أحكامه وفاعليتها من خلال ورش العمل والملتقيات والمؤتمرات.

Is the United States the cause of Arab Spring?

Many Arabs believe that the Arab Spring is a Western, and more specifically an American, plan since the days of former US Secretary of State Henry Kissinger to divide the Middle East into smaller rival nations to breed discord and plunder their wealth. Some subscribe to the theory that recent events in Egypt, Libya, Yemen and Syria point to a calculated plot to destroy Arab and Islamic countries and wipe out their rich heritage and history. The truth is that these theories generate self-loathing, suffering and pain, and, if they become firm convictions in the Arab mind, will invariably lead to the destruction of the Arab people. Such beliefs are highly dangerous and may cause a kind of psychological, moral and intellectual death among Arabs who keep feeling defeated and hopeless after this image has been planted in their minds.


Although I am not defending the United States and its Western allies, I am not at all surprised if they are planning to achieve their strategic goals by all available means to protect their interests in the Middle East. This should not be surprising, because this is how the game of international interests is played. Countries would be considered stupid and naïve if they do not look out for their own interests and do everything possible to protect their national interests. There is no place for ideals, justice or even ethics in the world of politics. It is all about (and nothing but) interests. This is what all previous civilizations — including the Arab and Islamic civilization — have striven for over the centuries. The love of domination and control and the lust for money and power over other people and nations have been a common objective for all of these civilizations, with only slight differences in execution. However, we must accept the fact that we often blame others for our problems without taking on any of the responsibility ourselves. This is unacceptable because it leads to defeat, surrender and submission.

The Arab Spring is a phenomenon of ordinary citizens rebelling against repression, much like other well-known revolutions. However, protesting in the streets is ineffective without self-liberation from ignorance, fear, surrender, and defeatism. Once the Arab world began speaking about elections and ballot boxes as a purpose and not a means to an end, Western countries seized upon this development as a way to benefit from these uprisings. Whether true democracy can succeed in these Arab nations remains to be seen. Underlying conditions such as extreme poverty, frightening ignorance, illiteracy, and widespread corruption must be addressed by new governments regardless of their adherence to democratic principles.

Yet, if one believes that America is the root cause of all of our problems, then I believe that only two options are possible:

The first is to surrender to the bitter reality and keep on complaining about what others are doing to us and blame them for everything. This will leave us with no other choice but to give up and accept this as our fate. We will have to spend the rest of our lives teaching our children and the coming generations that we have no other choice but to curse America, thereby admitting to ourselves and to the world that we are nothing but mindless sheep controlled by others.

The other option is to admit that the United States and its allies are not the real enemies, but instead is our defeatist attitudes. We must realize that the only way forward is to change our way of seeing things and restructure our way of thinking. We should remember that the Holy Qu'ran says: "Allah does not change a people's lot unless they change what is in their hearts."

Changing ourselves is not an easy task but it can be done if we follow these steps:


First: We must liberate ourselves from the notion that we are victims of a vast conspiracy to control our destiny. The idols of fear, cowardice, negativity, ignorance, and defeatism serve no purpose and prevent us from improving our lives. We must take responsibility for our mistakes. If it is true that the entire world is scheming to divide the Middle East and steal our resources, we should accept that reality and start thinking immediately of how to build an intellectual, cultural and civilized plan to combat the situation rather than continue to complain and wallow in fear.

Second: If, however, this conspiracy theory is nothing but an illusion that has nested in our minds, then we must realize that there still is a so-called game of international interests and that this game is an art that we have to learn how to play, even if we will not be able to reap the fruits right away.

Third: Idolizing others and perceiving them as symbols of absolute power reflect a sense of inferiority and disadvantage, which we have to get rid of right away, because any force in the world, no matter how big it is, is bound to have many weaknesses. A good example is what happened to America — the only superpower in the world — on Sept. 11, 2001 when a few individuals were able to attack it in a hideous terrorist attack.

Fourth: When people live in hatred and love of vengeance, they pave the way to destruction. Many nations have faced past challenges and difficulties but were able to leave them behind and move forward, like the tragedy of the Japanese at Hiroshima and Nagasaki. The Japanese decided that the best solution was to turn the page and focus on the future. They have not looked back since, and now we see them in the highest rank of the world's developed nations.

Thus, the time has come for all Arabs to rid themselves of this deep-rooted sense of inferiority and to confidently realize that the Earth is not heaven and not everyone on it are angels but human beings who vary in their love for good and evil. We must recognize that the game of interests and the lust for power and control over other people and their wealth have been and will always be a strategic goal for all nations till the end of time. There is no question that we can begin a new chapter of coexistence and self-confidence and stop blaming others for the Arab Spring out of an irrational fear based on a theory of International conspiracy.
